Plain English summary first. Legal version below. Effective May 15, 2026. We’ll tell you, with thirty days’ notice, if we ever change this in a way that affects you.

The short version. Be kind to other people. Don’t post things that are illegal or harmful. You own the content you make. We can suspend or terminate accounts that break our community guidelines. You can leave anytime; we’ll give you your data and refund unused subscription time when you do.

01 · Acceptable use

By using DailyMoment you agree to follow our community guidelines — the short version is be kind, be honest, be here. The guidelines cover the day-to-day; these terms cover the rest.

You agree not to: (a) use the service to harm or harass another person; (b) post or share content that’s illegal where you live or where we operate; (c) attempt to access another user’s account or our systems without authorization; (d) use automated tools to interact with the platform at scale, except via documented APIs; (e) commercially redistribute content without the original author’s permission; (f) impersonate someone else; (g) circumvent moderation, suspension, or banning of your account; (h) collect or scrape data about other users.

02 · Your account

You must be at least 13 to create an account, and at least 18 to use Dating Mode. You’re responsible for your password and any activity that happens through your account; tell us at safety@dailymoment.social right away if you think someone else is using it.

You may have one personal account. You can have one secondary account for a specific purpose (a hub you organise, a creative project) with a different handle. If you run a hub or campaign as a business, get in touch — we have an organisation account type coming.

03 · Your content

You own what you create. We don’t take any ownership stake in your moments, comments, messages, or any other content you post.

To run the service, you grant us a limited, non-exclusive, royalty-free license to host, transcode, store, and display your content to the audience you select, only for the purpose of operating DailyMoment. The license ends when you delete the content or your account.

You can grant us a separate, optional license to feature your moments in marketing (always with named credit, always with prior asking). The default is no.

04 · Our content

Our name, our logo, our typography choices, the design of this app, the words on this page — those belong to DailyMoment Inc. You may use our name and logo, without asking, for non-promotional commentary, journalism, criticism, and academic work. Don’t imply endorsement.

We open-source some of our internal tools. Anything in our public GitHub is governed by the license file in that repository, not by these terms.

05 · Subscriptions & payments

Moment+ is offered monthly ($5.99 USD) and annually ($48 USD). Renewals are automatic until you cancel. Cancel anytime in the app, two taps; you keep Moment+ until the end of your current period.

Refunds. Annual plans, full refund within fourteen days, no questions. Monthly plans, pro-rata for unused time if you cancel for a reason that’s on us. For other reasons, write to help@dailymoment.social — we mostly say yes.

Price changes. We will not raise the price of an active subscription mid-term. If we change prices for renewals, we tell you at least sixty days before your next renewal.

Brand prompts. Some prompts are sponsored. They’re always labelled. We share, in aggregate, audience demographics with brand partners; we don’t share anything that identifies you.

06 · Termination

You can leave anytime. Settings → Account → Delete. Thirty-day grace period to undo, then full deletion. We refund unused Moment+ time on the way out.

We can terminate accounts that violate these terms or the guidelines. We’ll tell you why, in writing, with the relevant excerpts. You can appeal. For severe violations (CSAM, credible threats of violence, repeated harassment after warnings), termination is immediate and final.

If your account is terminated, you still own your content, and you can still download it for thirty days via the export tool we email you.

07 · Warranties & liability

We try hard to keep the service running and to protect your data. We can’t guarantee perfection. The service is provided “as is.” To the extent allowed by law, our total liability to you for any claim relating to the service is capped at the greater of $100 USD or what you’ve paid us in the twelve months before the event giving rise to the claim.

Some jurisdictions don’t allow these limits. If you live in one of those places, the legal limits apply, not ours.

08 · Disputes

If you have a complaint, start with help@dailymoment.social. We try to resolve everything in under five business days.

If we can’t resolve it that way, we agree (and you agree, by using the service) to first attempt mediation through an accredited mediator in Ontario, Canada, before any formal proceedings. You and we share the cost of mediation.

If mediation doesn’t resolve the matter, disputes go to the courts of Ontario, Canada, except where local consumer law requires otherwise. We do not require binding arbitration. We do not require waiving class action rights.

09 · Changes

If we change these terms in a way that affects your rights or obligations, we tell you at least thirty days in advance, in the app and by email. Continued use after the effective date is your acceptance. If you don’t agree, you can close your account before the new terms take effect; we’ll refund unused subscription time.
